Godfrey ‘Pro’ Pinder, the lawyer for MacIntosh, told the court that there was “a double jeopardy” in the Supreme Court murder trial of his client.
Mr. Pinder said “it was a miscarriage of justice” for the trial judge to alow evidence from a previous murder trial that MacIntosh had already been acquitted of to become a contributing factor in his second murder trial of a different individual.
“It is unreasonable and cannot be supported having regard to the evidence and amended notices of appeal. Putting a case that was already tried and the appellant was acquitted is prejudice,” Mr. Pinder said.
