Constable Mervin Omar Smith, 21, of Bay Lilly Drive, Sea Breeze Estates, is facing a charge of unlawful sexual intercourse.
The accused was not handcuffed as he was led out of the court to a waiting cell at the Nassau Street Police Station by a single uniformed officer. It is believed that officers were unable to handcuff Smith due to the elbow length cast that held his injured right arm.
According to court reports, Smith allegedly had sex with the 12-year-old between 2003 and February of 2004.
