According to industry sources, Kerzner International Limited, owner of the Atlantis, Paradise Island, Bahamas has begun litigation in the United States District Court, District of Nevada against Monarch Casino and Resort, owner of the Atlantis Casino Resort in Reno, Nevada.
Kerzner International is “seeking the court’s declamatory judgement prohibiting Monarch from using the name ‘Atlantis’ in connection with offering casino services other than at Monarch’s Atlantis Casino Resort in Reno Nevada, and particularly prohibiting Monarch from using the ‘Atlantis’ name in connection with casino services in Las Vegas, Nevada. Kerzner is also seeking “injunctive relief and its enforcement”; unspecified compensatory and punitive damages and other relief”, according to media reports.
Monarch’s position is that the lawsuit is “entirely without merit” and intends to “defend itself vigourously”. Furthermore Monarch maintains that the “legal and contractual rights” which it possesses will “lead to its successful defence against the claims”.
