Businesses Win in Court

In a case with wide-ranging implications, the Supreme Court decided that businesses are entitled to recieve millions of dollars in compensation for the government’s decision to make sections of Blue Hill Road and Market Street one-way thoroughfares as part of the New Providence Road Improvement Project (NPRIP).

The government may have to compensate as many as 50 businesses in the Coconut Grove Business League (CGBL) as a result of the ruling by Justice Neville Adderley.

The CGBL requested a judicial review of the government’s decision arguing that the road changes significantly reduced business in the area. Some businesses, such as Super Value, reportedly suffered sales decreases as much as 80 percent.

Judge Adderley ruled that Minister of Works and Transport Neko Grant erred when he did not consult with the businesses regarding how the changes would affect their businesses.

Attorney General John Delaney, representing Minister Grant, argued that the judicial review should be thrown out because the specifics of the road project were announced more than a decade ago.

Adderley rejected that argument and ordered that costs be payed to the CGBL’s legal team, headed by attorneys Maurice Glinton and Paul Moss.
