Nassau, Bahamas – Attorney General and Minister of Legal Affairs Senator the Hon. John Delaney announced during a news briefing July 6 that the Court of Appeal has “allowed” the appeal in the Coconut Grove Business League matter.
In 2010 The Government appealed the ruling of the Supreme Court to allow the association of business owners compensation for losses as a result of roadworks on Baillou Hill Road and Market Street corridors, a part of the New Providence Road Improvement Project (NPRIP).
“In allowing the appeal it also vacated the order in respect of damages that had been granted by the Supreme Court pursuant to the judgment the Hon. Justice Neville Adderley on the 17th December 2010,” said the Attorney General.
Mr. Delaney described the ruling as a “very important” one as it relates to a major infrastructural project that is presently ongoing for the benefit of all Bahamians and residents on the island of New Providence.
“The NPRIP is not just about roads,” said Mr. Delaney. “ “It is about a major infrastructural upgrade and expansion in the island of New Providence that includes water, electricity as well as roads and other related public infrastructure.
“It is a network of 19 major corridors and several intersections and that is why it was important to ensure that with respect to each of the predetermined 19 corridors, that they are all in place and in accordance with the overall conceptual engineering design.”
The project is a network and the optimal benefit that it has been designed for with respect of the network only happens when all of the parts of the network are in place, Mr. Delaney said.
The reasons for the Court of Appeal’s decisions are to be announced at a later date.
