The Court of Appeal yesterday ordered a retrial and quashed the conviction and sentence of two men condemned to death in 2010 for the murder of Police Corporal Eddison Bain.
Acting Justice Jethro Miller informed the jury of his decision to allow the contested confession statements into evidence.
Justice of Appeal Abdulai Conteh said the judge’s actions were further aggravated when he proceeded to give his reasons for allowing the statements into evidence.
Conteh said this had a “material bearing” on the jury’s decision and rendered the convictions “unsafe and unsatisfactory.”
The men will also be retried on armed robbery and kidnapping charges.
Their lawyers, Jairam Mangra and Roger Gomer Jr., have informed the court of their intention to seek bail for the men pending a new trial.
