Bahamas Police Launch Investigation Into Trial No-Show

A full investigation will be conducted to determine why a police officer failed to appear as the material witness in a murder trial resulting in the jury being directed to deliver a not guilty verdict, Reginald Ferguson, assistant commissioner of police with responsibility for crime has vowed.


The acquittal came days after Ian “Ire” Porter and Margin Reckless were acquitted of the murder of Donald Smith who was shot dead at a beach party at Lyford Cay after witnesses in their murder trials also failed to appear.


Police Constable 802 Sean Ferguson was to have been the material witness in the murder trial of Andre Kikivarakis earlier this week. Kikivarakis was standing trial for the 2001 murder of Wade Clark who was shot and killed while at the Queen Elizabeth Sports Centre.


Yesterday, Mr. Ferguson told The Tribune that a full investigation would be launched. He said right now police are awaiting the report from the court with the specifics of the case.

However, he stressed that failing to appear in court is a “no-no” for police officers. “How can a police fail to appear in court, he must be dead.”
